Terms of service.
These terms govern your use of the Sable website and platform. By accessing the site or using the platform you agree to these terms.
Definitions
"Sable" refers to Sable Limited, the operator of the Sable platform. "Customer" refers to a business entering into a written subscription agreement for the Sable platform. "Platform" refers to the Sable software-as-a-service product available at getsable.io.
Subscription & payments
Use of the Sable platform requires an active subscription. Subscription terms, transaction volume thresholds, and overage pricing are documented in the order form executed between Customer and Sable. Annual subscriptions are billed in advance.
Service levels
Service-level commitments are defined in the order form. Standard SLA is 99.9% uptime on the Growth tier and 99.99% on the Scale tier.
Customer data
Customer retains ownership of all data submitted to the platform. Sable acts as data processor on the Customer's behalf, in accordance with the Data Processing Agreement executed alongside the order form.
Acceptable use
Customers must not use the platform to send unlawful content, infringe intellectual property, or attempt to compromise the security or integrity of the platform.
Term & termination
Subscriptions renew automatically for successive twelve-month terms unless either party provides written notice of non-renewal at least sixty days before the renewal date.
Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, or consequential damages. Sable's aggregate liability under this agreement is limited to the fees paid in the twelve months preceding the claim.
Governing law
These terms are governed by the laws of New Zealand. The parties submit to the exclusive jurisdiction of the courts of New Zealand.
